Section 17
Federal Parliament Service
(1) Federal Parliament Service gazetted special category posts in accordance with section 26 and the following posts will be filled as follows:- Positions through promotion through open competition through evaluation of performance through internal competitive examination through adjustment of promotion through evaluation of performance and experience (a) Unranked - Gazetted fifth category-- ––(b) Gazetted Unlisted Fourth Class––––(c) Gazetted Unlisted Third Class––––(d) Gazetted Unlisted Second Class60%20%20%–(e) Gazetted Unlisted First Class60%20%–20% f) Gazetted third class70%10%10%10% (g) Gazetted second class10%60%20%10% (h) Gazetted first class10%60%20%10% (2) Clause (c) of sub-section (1) Notwithstanding anything written in the Gazette, if any employee is not appointed in the third category post, such post will automatically be cancelled. If an employee working in a gazetted third-class post has reached the required service period for the post to be promoted and the educational qualification prescribed for one rank below the rank of the post to be promoted, he will be promoted to a post one rank higher. For such promotion, a higher rank post will automatically be created and the post held by him before he is promoted to a higher post will be automatically considered to have been abolished.
(3) The unranked/Gazetted fifth category posts performing main functions and supporting functions shall be as per the prevailing Civil Service Act or prescribed under that Act.
(4) The unranked/gazetted fifth category posts which are vacant at the commencement of this section and which are vacant after the commencement of this section and perform the ancillary duties specified in sub-section (3) shall be automatically cancelled. The secretariat should send the information about cancellation of such posts to the civil library. The work to be carried out from such positions should be done through a service contract by making an agreement with a person or an organization for a minimum wage.
(5) Internal competition as per clause (d) of sub-section (1).In the post to be filled by examination, the post must be filled by competition from the employees working in any post (including unclassified posts) who have completed the minimum educational qualification and minimum service period required for the gazetted second category post.
(6) Notwithstanding anything written in sub-section (1), in order to make the legislature-parliamentary service inclusive, forty-five percent of the posts to be filled by open competition shall be set aside and that percentage shall be considered as 100%, and the posts shall be filled by separate competition only among the following candidates:-
(a) Female thirty-three percent
(b) Tribals/tribes twenty-seven percent
(c) Madhesi twenty two percent
(d) Dalit nine percent
(e) Handicapped Five percent
(f) Backward Areas Four percent Explanation:
(1) For the purposes of this sub-section, "backward area" means the districts of Acham, Kalikot, Jajarkot, Jumla, Dolpa, Bajhang, Bajura, Mugu and Humla.
(2) For the purposes of clauses (a), (b), (c) and (d) of this sub-section, “women”, “tribals, tribes”, “Madhesi” and “Dalit” means economically and socially backward women, Tribals, tribes, Madhesi and Dalits should be remembered.
(7) Notwithstanding anything written elsewhere in this section, the posts of the percentage determined in accordance with clause (e) of sub-section (6) shall be filled by competitive examination in such a way that only those with disabilities can compete as specified for a specific nature of work.
(8) In determining the percentage according to sub-section (6), if there is a coefficient (fraction) of less than one percent, such coefficient will be shifted to the next group immediately after the group in which the coefficient occurred.
(9) If a suitable candidate is not available in the advertisement of the year for which the advertisement is made for the post allocated as per sub-section (6), such post shall be included in the advertisement of the next year and if no suitable candidate is available even after such advertisement, such post shall be filled in the same year through open competition. Should be included in the post to be fulfilled.
(10) Sub-section (6) The system of filling positions by the percentage determined as per 10 years should be reviewed.
(11) If there is any dispute while determining the number of posts according to the percentage as per sub-section (6), the decision of the Public Service Commission will be final.
(12) According to sub-section (1) the positions to be filled by the adjustment of promotion based on performance and experience evaluation will be adjusted on the basis of seniority from the employees who are promoted according to section 35.
(13) Notwithstanding anything contained elsewhere in this section, the minimum qualification required for the gazetted second and first class posts to be filled by open competition in accordance with clauses (g) and (h) of sub-section (1) is to have obtained a master's degree in the relevant subject and to have obtained a master's degree in any government service or In the case of a gazetted second class post and seven years experience in the case of a gazetted first class post, an organized organization or an international association registered according to the prevailing law should have acquired experience at the authorized level of the organization. But in the case of a person who has obtained the title of Vidyavaridhi level, the period of experience will be reduced by two years.
(14) Legislature-Parliament service related to the filling of posts and other provisions related to specialist posts will be as prescribed.
